Subject Matter of the Contract

These General Terms and Conditions regulate the rental of lockers by Raum3 GmbH (hereinafter referred to as "Lessor") to the users (hereinafter referred to as "Lessee") at the Haldern Pop Festival 2024.

Conclusion of Contract

The rental contract is concluded when the lessee rents a locker and pays the corresponding rental fee.

Duration of Use

The use of the locker is limited to the duration of the event. Lockers must be emptied by the end of the event at the latest.

Rental Fee

The rental fee must be paid in advance and is non-refundable, even if the locker is vacated early.

Disclaimer of Liability

The lessor assumes no liability for the loss, theft, or damage of items stored in the locker. The lessee uses the locker at their own risk.

Duty of Care of the Lessee

The lessee is obliged to properly lock the locker and keep the key safe. In case of loss of the key, the lessee is liable for all resulting damages and costs.

Prohibited Items

The locker must not be used to store dangerous, illegal, or valuable items. The lessor reserves the right to open and clear lockers if misuse is suspected.

Compensation for Damages

The lessee is liable for any damage caused by improper use of the locker.

Processing and Return Costs

If the lessee's items remain in the locker after the agreed rental period due to the lessee's fault, they must bear the processing and return costs when the items are sent to the address provided at the time of contract conclusion. A flat fee of €25 is charged by the provider for processing and return. This fee must be paid by the lessee before the items are shipped. The provider will exercise their right of retention until payment is received. The return of items will only occur after the lessee has been identified and the data provided at booking has been verified. The provider assumes no liability for any damage that may occur during the return shipment.

Deposit

The lessee is required to deposit €10.00 as a security deposit upon receiving the key system (key and cloakroom tag). The deposit amount will be refunded to the lessee upon the proper return of the key system or offset against the rental fee or shipping costs in the event of a rental extension.

Data Protection

The lessor collects and processes the lessee's personal data solely for the purpose of executing the rental contract. Data will not be passed on to third parties unless there is a legal obligation to do so.

Miscellaneous

Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid regulation that comes closest to the economic purpose of the invalid provision shall be deemed agreed.

Jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction, as far as legally permissible, is the seat of the lessor.
